Ultimate Fan Photo ContestContest entrants agree to abide by the terms of these Official Rules and by the decisions of The Roanoke Times and the Salem Red Sox. All decisions made by The Roanoke Times and the Salem Red Sox are final on all matters pertaining to the contest. This Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or The Roanoke Times. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.The Ultimate Fan Contest is comprised of six rounds. In the first five rounds, users submit photos showing their Red Sox spirit, then winners are selected by popular vote. Each round consists of a submission period and then a voting period. Winners will be announced online and at the Salem Red Sox games. Winners from the first five rounds will be automatically entered into Round 6.

Prizes:There will be six rounds of the Ultimate Fan Contest. Winners will be determined by popular vote. The winner of the first five rounds will receive a suite night at a Salem Red Sox game for up to 15 people. Food and beverage will be included. Some restrictions apply.The winners of the first five rounds will be automatically entered into the sixth round. The winner of the sixth round will be determined by popular vote. That winner will receive a trip to see a Boston Red Sox Game at Fenway Park. Includes airfare, game tickets and hotel accommodations for 4. Some restrictions apply.
Submissions:Contest entrants (“entrants” or “you”) must be a legal U.S. resident 13 years of age or older at time of entry to be eligible for this contest. To claim a prize, any minors must be accompanied by an adult, age 18 and older. This contest is void where prohibited by law. As described below, there are certain persons who are ineligible to be contestants.Each entrant is required to submit an original photo. Modifying, enhancing or altering a third party’s preexisting work does not qualify as an entrant’s original photo. However, submission of two photos combined to make one photo is acceptable. Each submission must be in keeping with the positive image of The Roanoke Times and the Salem Red Sox and may not be offensive, inappropriate, as determined by The Roanoke Times and the Salem Red Sox. The Roanoke Times or the Salem Red Sox have the right to reject or disqualify a photo (including related captions) for any reason in its sole and absolute discretion.The Roanoke Times also reserves the right in its sole discretion to disqualify any contestant who tampers or attempts to tamper with the entry or voting process or who acts in an unsportsmanlike or disruptive manner as defined by The Roanoke Times. The Roanoke Times failure to enforce any term of these rules shall not constitute a waiver of the provision.
Authorizations/Consents/Licenses:By entering this Contest and submitting a photo, each entrant: (a) is representing that the entrant is the copyright owner of the photo or has written permission from the copyright owner to enter the photo in the contest; (b) is thereby granting The Roanoke Times and Salem Red Sox all rights necessary to use the photo in the contest, including but not limited to an irrevocable license to edit, publish, republish, distribute and copy the photo and/or the edited photo an unlimited number of times in any print, electronic or other medium; (c) has obtained from anyone identified or depicted in the photo (or the parent or guardian of any child identified or depicted) all permission necessary to grant The Roanoke Times and Salem Red Sox the foregoing license; and (d) is thereby granting to The Roanoke Times and Salem Red Sox the right to use and publish their proper name, city and state in print, online, or any other electronic or digital media, in connection with the contest.The Roanoke Times also reserves the right to use any and all information related to the contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
Selection of Winners:The winners will be selected by popular vote. Registration is not required to vote.The Roanoke Times, with the technical support of Upickem, shall tally all votes that are submitted in accordance with these Official Rules.
Notification of Winners:All results posted are unofficial until winners respond to notification from The Roanoke Times.Odds of winning depend on the number of eligible entries received.
Winners:Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize. The Sponsors are The Roanoke Times, Salem Red Sox and Upickem.Each winner shall be solely responsible for the timely payment of all federal, state and local taxes and will be required to complete an IRS form W-9.The Sponsors reserve the right to withhold prizes until a completed form W-9 is received, and the Acknowledgement forms agreeing the winner’s obligations.
Disqualified/Ineligible Contestants:Employees and contractors of The Roanoke Times, Salem Red Sox or their respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members (defined as parents, spouse, children, siblings, grandparents, and/or any person with whom they are domiciled) of each are not eligible. People who meet this definition cannot be depicted in any photo entered in the contest.
Additional Contest Rules:No purchase is necessary to enter or win. Times-World, LLC, d/ba/ The Roanoke Times is providing this contest, powered by Upickem in partnership with the Salem Red Sox. This Contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.The Roanoke Times reserves the right to change these Contest rules at any time.The Roanoke Times and Upickem are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God. The Roanoke Times reserves the right to terminate, modify or suspend the Contest if, in The Roanoke Times opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest (including the voting phase of the contest).If viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond The Roanoke Times reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest we reserve the right to terminate the contest. In such an event, The Roanoke Times reserves the right (but does not have an obligation) in its sole discretion to award the prizes based on the last tally of votes for non-suspect entries received up to the time of the suspected impairment. |
