“Oh, Say, Can You Sing?” Contest Rules
No purchase is necessary to enter or win. Times-World, LLC and its subsidiaries and
affiliates (“Times-World” or “The Roanoke Times”) are providing this contest, which is
powered by Upickem.
Eligibility:
Contest entrants (“entrants” or “you”) must be a legal U.S. resident 18 years of age or
older or the age of legal majority in your state of primary residence at time of entry to be
eligible for this contest. Parents or legal guardians may enter a performance of a minor
(younger than eighteen (18) years of age as of June 6, 2011) in their care. The Grand
Prize winner must be willing and available to perform live on July 4th, 2011, at The
Roanoke Times Music for Americans (“MFA”) event at River’s Edge in Roanoke,
Virginia. Employees, shareholders, officers, directors, agents, and representatives of
Times-World, or their respective parent companies, affiliates, subsidiaries, divisions,
agents, representatives and promotional agencies, and their immediate family members
(defined as parents, spouse, children, siblings, grandparents or grandchildren) and/or any
person with whom they are domiciled are not eligible, and people who meet this
definition cannot be depicted in any video entered in the contest. This contest is void
where prohibited by law.
How to Enter:
One video entry per person. To enter the contest, you must submit only one video (the
“video”), of yourself, or dependent child, performing the first stanza of The Star
Spangled Banner with no assistance from musical accompaniment (a cappella only).
Audio-only submissions will not be accepted. Upload and send the video via electronic
delivery through the contest site at roanoke.com/contests, together with your full name,
mailing address, e-mail address and telephone number(s). Videos must be received by
11:59 a.m. on Monday, June 6.
Submission Requirements:
The video must be entirely your original work and must not contain material that
violates or infringes another's rights, including but not limited to privacy,
publicity or intellectual property rights, or that constitutes copyright infringement
(including copyrighted music, lyrics, images, photos, artwork, script, or footage);
disparages Times-World, or any other person or party affiliated with the
promotion and administration of this Contest;
depicts brand names, location signage, trademarks, or logos;
is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous or
libelous;
promotes bigotry, racism, hatred or harm against any group or individual or
promotes discrimination based on race, gender, religion, nationality, disability,
sexual orientation or age; or
is unlawful, in violation of or contrary to the laws or regulations in any
jurisdiction where video is created.
The Roanoke Times reserves the right to disqualify in their sole and absolute discretion
any videos that violate the contest rules.
Selection of winners:
Once the entry period closes, a panel of experts (selected by The Roanoke Times) will
review the entries and choose the finalists in the contest. The finalists will be posted on
the contest site Tuesday, June 7 at 10 a.m. Public voting will begin at that time and end at
11:59 a.m. (one minute before noon) on Monday, June 20, 2011. The top 3 eligible vote
getters will be announced in The Roanoke Times June 24, 25 and 26, 2011.
Winners will be notified by telephone and/or email on or about June 24, 2011. The
winner agrees to be featured in a story in The Roanoke Times and on roanoke.com.
Ties will be broken by Times-World.
Prizes:
Odds of winning depend on the number of eligible entries received.
One Grand Prize winner will perform at the Monday, July 4, 2011 Music For Americans
gathering at River’s Edge in Roanoke, and receive a gift card valued at $500. If the
Grand Prize winner is unable or unwilling to sing the first stanza of the national
anthem live at MFA, he or she forfeits the prize, including the gift card, and the next
highest vote getter will automatically become the Grand Prize winner.
The second place winner will receive a gift card valued at $300. The third place winner
will receive a gift card valued at $200.
All results posted are unofficial until winners claim their prizes from Times-World.
Winners must claim their prizes no later than December 31, 2011. The failure to claim a
prize by December 31, 2011 will result in forfeiture of the prize and, in such case, The
Roanoke Times will donate the prize(s) to Roanoke Area Ministries, a charitable
organization.
Additional Terms:
Entrants agree to abide by the terms of these Official Rules and by the decisions of the
contest commissioners, which are final on all matters pertaining to the contest.
By entering the contest, (i) you represent that you are the copyright owner of the video,
(ii) you grant to Times-World all rights necessary to use the video in the contest, (iii) you
grant to Times-World a worldwide, perpetual, fully-paid up, irrevocable license to edit,
publish, republish, distribute and copy the video and/or the edited video an unlimited
number of times in any print, electronic or other medium, (iv) you represent that you
have obtained from anyone identified or depicted in the video (or the parent or guardian
of any child identified or depicted) all permission necessary to grant Times-World the
foregoing license, and (v) you grant to Times-World the right to use and publish your
name and state of residence online and in print, or any other media, in connection with
the contest.
Times-World reserves the right to use any and all information related to the contest,
including information on contestants obtained through the contest, for marketing
purposes or any other purpose, unless prohibited by law.
Each winner, by acceptance of the prize, releases and agrees to indemnify, defend and
hold harmless Upickem and Times-World, and each of their respective parents,
subsidiaries, affiliates, officers, directors, employees, agents, shareholders, affiliates,
suppliers, distributors, and advertising agencies from all liability, claims, or actions of
any kind whatsoever for injuries, damages, liability or losses which may be sustained in
connection with the contest or the receipt, ownership, or use of the prize.
Times-World and Upickem are not responsible for Internet crashes or slowdowns caused
by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical
outages, natural disasters or acts of man or God.
Each winner is responsible for all federal, state and local taxes and will be required to
complete an IRS form W-9. Times-World reserves the right to withhold prizes until
completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the
contest for gambling purposes they will be disqualified and reported to authorities.
Times-World reserves the right to change these contest rules at any time.
